Base Currency

All fees and prices are in US Dollars (USD). You might see prices/fees in your local currency based on standard currency exchange.

Changing of Prices

Site prices are subject to modification at any time. Prices may also vary due to a launching price, a promotional offer or sales. Prices of items that are not in stock or that are available for a pre-order are valid during its promotional period after the order was placed. Should the price of those items change with respect to the pre-order price, the Customer will be informed and will have the possibility to cancel the order. We reserve the right to update prices displayed on the Site from time to time and once updated, they cannot be claimed against an order that has already been confirmed or delivered.

Due to human error and other determinates, we cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information listed are entirely accurate, complete or current, nor can we assume responsibility for these errors. In the event a product listed on our Web site is labeled with an incorrect price due to some typographical, informational, technical or other error, we shall at our own sole discretion have the right to refuse and/or cancel any order for said product and immediately amend, correct and/or remove the inaccurate information.

Orders

Placing an Order

Placing an order can be done from the Site. Should you place the order from the Site, you have to be sure that personal data is correct and updated. We suggest Customers proof-read the order form several times before validating the order. We are neither responsible for sending e-mails to the wrong e-mail address nor for sending parcels to the wrong delivery address if the form is incorrectly filled-out.

Order Processing Time

You can expect your order to be processed within approximately 48-72 hours, provided the items are in stock. We do not guarantee same day shipping. Orders are not processed on weekends and holidays.

Order Acceptance Policy

Your receipt of electronic or other forms of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right, at any time after receipt of your order, to accept or decline your order for any reason. We reserve the right, at any time after receipt of your order, to supply less than the quantity you ordered of any item without prior notice to you. We may require additional verifications or information before accepting any order.

Order Acknowledgement

We will keep you informed of your order status via e-mail. All tracking information will be emailed to your registered email-ID once your order has processed or changed its status. You may also acquire your order status and other live updates by logging in to your account on our Site.

Cancel Orders

You may request for order cancellation, provided the order has not already been processed and shipped.

Payment

We offer Cash on Delivery (CoD) (Depends on Country) and Credit Card and Debit Card payments: You can pay cash to our representative delivering your product.

We reserve the right to refuse a delivery or honor an order from a Customer who has not paid part or the totality of a previous order or with whom a litigious dispute is in progress. We also reserve the right to take any necessary steps including legal action in case of outstanding or non-payment of fees by you.

Invoice

The order form filled out online by the Customer cannot be considered as an invoice. Regardless of the purchase or payment methods, the Customer receives an invoice inside his/her parcel when it is delivered. A digital copy of each invoice is registered in our secure and encrypted database.

Security

We will take all reasonable precautions to ensure the security of any payment details included in your order nevertheless, barring direct negligence on our part, we cannot be held liable for any losses incurred as a result of unauthorized access to the information you may provide. Disputes

If any dispute, claim, controversy or difference (including in relation to any tortious or statutory claim) (“Dispute”) arises out of or in connection with or in relation to this User Agreement, including (without limitation) any question regarding the formation, existence, scope, performance, interpretation, validity or termination of this User Agreement or this clause, or any question regarding the legal relationships established by this User Agreement or the consequences of its nullity, then the parties shall first attempt amicably to settle the dispute through good-faith negotiations over a period of thirty (30) calendar days commencing on the date that a party first sends to the other party a written notice of the Dispute.

In the event that a Dispute has not been settled amicably by the relevant parties by the end of such thirty (30) calendar day period, the parties hereby agree that the Dispute shall be referred to and finally resolved by binding arbitration as set out below, under the Arbitration Rules of the US Courts under law, which rules (“Rules”) are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one.

The arbitration proceedings shall be conducted in the English language and the award shall be in English. The foregoing provisions of this clause are without prejudice to the right of Nuqipropducts.com to seek interim relief at any time from any court of competent jurisdiction (whether or not an arbitrator has been appointed) and Nuqipropducts.com shall not be deemed to have breached this arbitration agreement or infringed the powers of the arbitrator for having done so.

Feedback

You may have the opportunity to provide reviews, suggestions, ideas, and feedback, (hereinafter, collectively, “Feedback.”) Should you so provide such Feedback you grant us sole ownership of the same, which includes without limitation the right for us or any Third Party we designate, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, create derivative works of, host, index, cache, tag, encode, modify and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technologies) in any form or media now known or hereinafter developed. All such Feedback shall be treated as non-confidential.

We reserve the right to modify or delete your feedback if it contains the content against Nuqipropducts.com or its affiliated business partners. You also agree not to use any pseudo name or fake identity to post feedback. We will delete feedback from pseudo accounts and might take legal action against the feedback poster.

LIMITATIONS OF LIABILITY

IN ALL CIRCUMSTANCES NUQIPRODUCTS.COM’S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. NUQIPRODUCTS.COM SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. NUQIPRODUCTS.COM SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT NUQIPRODUCTS.COM HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

If you are dissatisfied with the Site or any content or materials on it, your sole exclusive remedy is to discontinue your use of it. Further, you agree that any unauthorized use of the Site and its services as a result of your negligent act or omission would result in irreparable injury to Nuqipropducts.com and we shall treat any such unauthorized use as subject to the Terms.

Products deemed to be super-savers or highly discounted by the company might be limited by quantity per order and the company reserves the right to alter ordered quantity for such products and or cancel the order with or without consent of the customer.

We reserve the right to cancel any unpaid order under any circumstances without any owed liability towards a customer or otherwise, in-case of paid order we still reserve this right as long as the paid amount is returned in full.

Intellectual Property

All content included on the Site, such as text, graphics, logos, images, audio clips, video, data, music, software, and other material (collectively “Content”) is owned or licensed property of Nuqipropducts.com or its suppliers or licensors and is protected by copyright, trademark, patent, or other proprietary rights. The collection, arrangement, and assembly of all content on the Site is the exclusive property of Nuqipropducts.com. We and our suppliers and licensors expressly reserve all intellectual property rights in all Content.

Governing Law

This User Agreement is governed by and construed in accordance with, US law. This clause will survive any expiry or cancellation of this User Agreement for any reason.

Updates

We may from time to time modify or change the Terms. The revised Terms will govern your future use of our Site, so we strongly suggest that you visit and review our Terms periodically. Each version is specifically dated. If you do not agree to the revised version, you must immediately stop using our Site.

Warranty Policy

All warranty periods indicated are from Nuqipropducts.com, unless otherwise noted, and are limited by the manufacturer’s warranty policies. Actual manufacturer warranty periods may vary depending on product and manufacturer and may be longer than the warranty period covered by Nuqipropducts.com. Please refer to the manufacturer’s website or product manuals/packaging for more information.

Generally, the manufacturer’s limited warranty will only cover the product for manufacturing defects and will not cover any physical damage to the product from misuse, dropping, any damage, etc. In no way does Nuqipropducts.com warrant any product for fitness of use or for representations made by the manufacturer.

All communication for updates/feedback on complaint tickets created is made either by email or by a call. In the event an email update or a call is unanswered for 3 days, the complaint ticket would need to be closed and a new complaint ticket would need to be created, provided the item is still under warranty.

Refund Policy

To claim for a Refund, please check if the purchased Product(s) fall under the warranty as per the Warranty Policy. If the Product(s) fall under warranty, then you can claim for refund based on the following conditions:

  • Customers can claim a refund for the purchased Product(s) within 3 days from the date of receiving the Product(s).
  • Physically damaged and/or missing Product(s) cases will only be considered if reported at the time of delivery.
  • The amount of the Refund only covers the amount of Product(s) purchased.
  • Shipping and payment processing charges are non-refundable
  • If a coupon, discount, or special offer was part of the original order, the amount will be deducted as well.
  • Refunds will be made through the original mode of payment
  • Nuqipropducts.com reserves the right to compensate the claim in terms of Coupon as and when it deems fit.
Refund Process

If the Product(s) is qualified for the Refund, then please follow the below process to claim for a Refund:

  • Raise a Complaint: Use this guide to raise a complaint and save Complaint Number for future reference.
  • Review: Our support team will review the case and approve the Refund if qualified.
  • You can file multiple complaints about different products received under one order, however, pick up charge is applicable on all subsequent complaints filed after the first one
  • Pickup Process: Once the complaint is approved, the product pickup process will start.
    • Within the US: The Product(s) will be picked up by our delivery team for UAE customers
      • There will be no pickup charges if the Return claim has been raised within 7 days (168 hours) from the time of delivery.
      • Pickup charges of USD 11 will be applicable if the Return claim is made after 7 days (168 hours) from the time of delivery.
      • Pickup request if canceled for any reason can be rescheduled on request without any additional charges, however, if 2nd pickup request is canceled, claim ticket will be auto closed.
    • All shipments need to be delivered to our address within 15 days from the date when the ticket is created. In the event, the item(s) is not received, the complaint ticket would need to be closed.
  • Inspection Process: After receiving the Product(s), it is sent for inspection:
    • Approved: If the Product(s) is found faulty as per the policy then the Refund process will be initiated.
    • Not Approved: For products returned in damaged condition or without complete accessories or box – item(s) to be returned to the customer
Quick and Hassle-free Warranty

Products with no specific warranty period are deemed as non-warranty items and complaint needs to be filed within 72 hours from the time of delivery.

Claims to be accepted based on the following conditions:

  • Product(s) should not be in used condition and should not show that it was previously used
  • Save the original seal.
  • Product(s) has the complete original packaging (if the product was sold in original packaging).
  • Physically damaged and/or missing Product(s) cases will only be considered if reported at the time of delivery.
  • Nuqipropducts.com reserves the right to compensate the claim in terms of a coupon instead of servicing the item as and when it deems fit.
  • For items not faulty and claimed due to the item not being as per expectations, pickup charges of (USD 11) and re-stocking fees (15% of product value) are applicable.
